1. Agreement to Terms
These Terms of Service ("Terms") constitute a legal agreement between you and BITWISE d.o.o. ("Vigicue," "we," "us," or "our") governing your use of the Vigicue mobile application, web application, and related services (collectively, the "Service").

2. Eligibility
2.1 Age Requirement
You must be at least 13 years old to use Vigicue. By using the Service, you represent and warrant that you are at least 13 years of age.
If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission to use the Service.
2.2 Geographic Restrictions
The Service is available worldwide, subject to applicable laws and regulations. You are responsible for ensuring your use of the Service complies with local laws in your jurisdiction.
3. License Grant
3.1 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- Download and install the Vigicue mobile application on devices you own or control
- Access and use the Service for your personal, non-commercial purposes
3.2 License Restrictions
You may NOT:
- Copy, modify, or create derivative works of the Service
- Reverse engineer, decompile, or disassemble the Service
- Remove, alter, or obscure any proprietary notices (copyright, trademark, etc.)
- Use the Service for any commercial purpose without our written permission
- Rent, lease, lend, sell, redistribute, or sublicense the Service
- Use the Service to violate any applicable laws or regulations
- Attempt to gain unauthorized access to any portion of the Service
- Use automated systems (bots, scrapers, etc.) to access the Service
- Interfere with or disrupt the Service or servers/networks connected to the Service
- Impersonate any person or entity, or falsely state or misrepresent your affiliation
- Transmit any viruses, malware, or other harmful code
4. Service Description
4.1 What Vigicue Provides
Vigicue is a mobile and web application that provides:
- Real-time NBA game notifications based on custom conditions (cues)
- Predefined game alerts (clutch time, tip-off, quarter starts, etc.)
- Multi-game monitoring capabilities
- Customizable alert configurations
4.2 Data Source
Game data is provided by third-party data providers. While we strive to provide accurate and timely information, we do not guarantee the accuracy, completeness, or timeliness of game data or notifications.
4.3 No Affiliation with NBA
Vigicue is an independent service and is not affiliated with, endorsed by, or sponsored by the National Basketball Association (NBA) or any NBA teams.
5. Subscriptions and Payments
5.1 Subscription Plans
Vigicue offers the following subscription options:
- Weekly Subscription: Renews automatically every week
- Monthly Subscription: Includes a free trial period, then renews automatically every month
Subscription prices are displayed in the app and may vary by country and currency.
5.2 Payment Processing
All payments are processed through the Apple App Store or Google Play Store, depending on your platform. Your subscription is subject to the payment terms and conditions of the applicable app store.
5.3 Free Trial
The Monthly Subscription includes a free trial period. You will not be charged until the trial period ends. If you cancel before the trial ends, you will not be charged.
5.4 Automatic Renewal
Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
You will be charged for the renewal within 24 hours prior to the end of the current period.
5.5 Managing Subscriptions
You can manage your subscription and turn off auto-renewal through your App Store Account Settings (iOS) or Google Play Account Settings (Android). Vigicue cannot directly cancel or refund subscriptions — you must manage them through the app store.
5.6 Cancellation
You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will continue to have access to subscription features until the end of the paid period.
5.7 Refunds
Refund policies are governed by the Apple App Store and Google Play Store terms. Generally, payments for in-app subscriptions are non-refundable except as required by applicable law or app store policies.
5.8 Price Changes
We reserve the right to change subscription prices at any time. Price changes will not affect your current subscription period but will apply upon renewal. You will be notified of price changes in advance.
6. Intellectual Property Rights
6.1 Our Ownership
The Service, including all content, features, functionality, software, code, design, graphics, logos, and trademarks, is owned by BITWISE d.o.o. and is protected by copyright, trademark, and other intellectual property laws.
6.2 Third-Party Content
Game data, team names, logos, and related NBA information are the property of the NBA and respective team owners. Use of such content is solely for displaying information within the Service and does not imply endorsement.
6.3 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate such feedback without any obligation to you.
7. Privacy and Data Protection
Your privacy is important to us. Our collection and use of information is governed by our Privacy Policy.
By using the Service, you consent to the collection and use of information as described in the Privacy Policy.
8. Third-Party Services and Links
8.1 Third-Party Services
The Service uses third-party services including:
- Google Analytics and Firebase Analytics (usage analytics)
- Sentry (crash reporting)
- Enetpulse (game data provider)
- RevenueCat (subscription management)
- Google Cloud Run (application hosting)
- Neon (database services)
- Apple and Google push notification services
Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third-party services.
8.2 Third-Party Links
The Service may contain links to third-party websites or services. We do not control and are not responsible for the content, privacy policies, or practices of third-party sites. You access third-party sites at your own risk.
9. Disclaimers and Limitations of Liability
9.1 Service "As Is"
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that the Service will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy, reliability, or timeliness of game data or notifications
9.2 No Guarantee of Availability
We do not guarantee that:
- The Service will always be available or accessible
- Notifications will be delivered on time or at all
- Game data will be accurate or complete
- The Service will be free from bugs, errors, or security vulnerabilities
9.3 Technical Issues
Your access to the Service may be interrupted due to:
- Maintenance, updates, or improvements
- Third-party service outages (data providers, cloud infrastructure, etc.)
- Network connectivity issues
- Device compatibility problems
- Force majeure events
9.4 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BITWISE D.O.O. SHALL NOT BE LIABLE FOR ANY:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Business interruption
- Damages arising from your use or inability to use the Service
- Damages resulting from third-party services or data providers
THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND WHETHER WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
9.5 Maximum Liability
Our total liability to you for all claims arising from your use of the Service shall not exceed the amount you paid to us in the 3 months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless BITWISE d.o.o., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your violation of any applicable laws or regulations
11. Termination
11.1 Termination by You
You may stop using the Service at any time by:
- Deleting the app from your device
- Canceling your subscription through the app store
- Ceasing to access the web application
11.2 Termination by Us
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Extended periods of inactivity
- Technical or security reasons
- Discontinuation of the Service
11.3 Effect of Termination
Upon termination:
- Your license to use the Service immediately ends
- You must cease all use of the Service and delete the app
- Your saved cues, preferences, and data may be deleted
- Subscription fees already paid are generally non-refundable (subject to app store policies)
11.4 Survival
Sections of these Terms that by their nature should survive termination will survive, including: Intellectual Property Rights, Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution.
12. Changes to the Service
We reserve the right to:
- Modify, suspend, or discontinue any aspect of the Service at any time
- Change features, functionality, or subscription plans
- Update system requirements or supported devices
- Remove or modify content within the Service
We will provide reasonable notice of material changes when practicable, but we are not obligated to do so.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by:
- Posting the updated Terms on this page
- Updating the "Last Updated" date
- Providing in-app notifications for significant changes
Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
14. Dispute Resolution
14.1 Governing Law
These Terms are governed by and construed in accordance with the laws of Slovenia, without regard to its conflict of law provisions.
14.2 Jurisdiction
Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Slovenia.
14.3 Informal Resolution
Before filing a formal legal claim, you agree to contact us at support@vigicue.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.
14.4 EU Users — Alternative Dispute Resolution
If you are a consumer in the European Union, you may also have the right to use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
15. Miscellaneous
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and BITWISE d.o.o. regarding the Service and supersede all prior agreements and understandings.
15.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
15.3 Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
15.4 Assignment
You may not assign or transfer these Terms or your rights under them without our written consent. We may assign these Terms without restriction.
15.5 No Agency
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and BITWISE d.o.o.
15.6 Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, natural disasters, pandemics, internet or telecommunications failures, or government actions.
15.7 Language
These Terms are provided in English. If translated into other languages, the English version will prevail in case of any conflict or inconsistency.

These Terms are between you and BITWISE d.o.o., not Apple Inc. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the Service. If the Service fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any), and Apple will have no other warranty obligation. Apple is not responsible for addressing any claims relating to the Service or your use of it, including product liability claims, consumer protection claims, or intellectual property infringement claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right to enforce these Terms against you.
